@butchjax gotcha. That's the issue though: it was "new the day before iOS 5" meaning: when iOS 5 was installed it was No Longer a 'new' phone. I assume that you restored from a back up After you installed iOS 5? Which, if you did, that is probably the crux of the problem. I have been reading the blogs and listening to podcasts about iOS 5 and Apple device issues. The consensus and experiential success is that if you wipe and restore as a new phone that the anomalies clear up. When you have time, it may be worth your while. :)
Good luck.

You hear parents say that when their kids were young that for a while they thought their parents 'knew all'. I think my kid skipped over that part...apparently. We've gone straight to 'mom & dad don't know what they're talking about'. The funny part is that she asks us questions All the time and when we answer her she says "Nuh-uh, that's not right." My retort is then "Okay. Why are you asking?"
That still stops her. She hasn't yet got an answer for that, but that one will probably be forthcoming. :)

@butchjax I know it's a pain to re-input all your account data--I don't like doing it either--, but a restore 'as new' will take care of that kind of stuff.
Have you already tried a 'hard reboot'? (Hold down the sleep/wake button and the Home button at the same time until you go through the 'slide to turn off' screen and the black screen and Keep Holding them down until you see the Apple Logo appear in the middle of the black screen, then release). Try this, if you haven't, and see what your phone is like afterwards.
If you've already done this, then your best, quickest, most successful option is to restore as a 'new phone'. That will most certainly fix it. Pain in the ass, but it will rectify the issues.

@butchjax it matters what model you have because not all the OS upgrades act the same on all models of the phone (sometimes). This happened to me in the past with iOS 4 when I had my iPhone 3G. The 3G still 'qualified'(was included in) for the upgrade, but it (the new OS) did not run optimally on that model. Doing a 'restore as new' may be what Apple peeps would suggest.
