@butchjax it matters what model you have because not all the OS upgrades act the same on all models of the phone (sometimes). This happened to me in the past with iOS 4 when I had my iPhone 3G. The 3G still 'qualified'(was included in) for the upgrade, but it (the new OS) did not run optimally on that model. Doing a 'restore as new' may be what Apple peeps would suggest.
